Supreme Court rules on GPS tracking, but punts on larger issues

Monday?s Supreme Court ruling invalidating a conviction based on evidence gained by GPS tracking of a suspect's car might seem like a victory for privacy advocates. But on the critical issues of privacy and Fourth Amendment rights, the majority of the court actually punted.?

The unanimous opinion issued Monday morning is among the first in which the Supreme Court has decided a case at the thorny 21st-Century intersection of law, technology and privacy.? Police in Washington, D.C., had tracked a suspect by placing a tiny GPS device on his car, then tracking his movements for about a month. While the trial court held that evidence obtained through the GPS amounted to surveillance of the suspect's movements through public spaces, an appeals court ruled that it constituted an illegal search and seizure and a violation of Fourth Amendment rights.? The Supreme Court affirmed the decision.?

There was a remarkable amount of disagreement, however, in this unanimous decision. The court issued perhaps the narrowest ruling possible -- essentially that placement of the GPS on the car constituted a violation of property and effects rights, akin to trespassing, therefore spoiling any evidence garnered through the process.? Left undecided: What rights do citizens have when law enforcement uses other technological methods to track their whereabouts?

Justice Sonia Sotomayor, while concurring with the decision, delivered a separate opinion dripping with disappointment.

"With increasing regularity, the government will be capable of duplicating the monitoring undertaken in this case by enlisting factory- or owner-installed vehicle tracking devices or GPS-enabled smartphones. In cases of electronic or other novel modes of surveillance that do not depend upon a physical invasion on property, the majority opinion?s trespassory test may provide little guidance," she wrote.

Electronic law expert Mark Rasch, former head of the Justice Department's Computer Crime unit, said the opinion has "almost given carte blanche to law enforcement to go ahead and try to find their way around" the ruling, such as enlisting the help of cell phone providers to track citizens in their cars.

Sotomayer clearly regretted that the majority did not take the opportunity to make a more definitive ruling on privacy and Fourth Amendment rights, Rasch said. In her opinion she raised the complex issue of law enforcement agencies increasingly using private firms to aid in surveillance and evidence gathering. Rules governing evidence originally obtained by third parties are unclear, but generally offer fewer rights that rules governing law enforcement investigative techniques.

"This approach is ill suited to the digital age, in which people reveal a great deal of information about themselves to third parties in the course of carrying out mundane tasks," Sotomayer wrote. "People disclose the phone numbers that they dial or text to their cellular providers; the URLs that they visit and the e-mail addresses with which they correspond to their Internet service providers; and the books, groceries, and medications they purchase to online retailers. ? I for one doubt that people would accept without complaint the warrantless disclosure to the government of a list of every website they had visited in the last week, or month, or year."

Justice Samuel Alito also seemed frustrated by the court's failure to take on the deeper issues raised in the GPS tracking case.

"(This opinion) largely disregards what is really important (the use of a GPS for the purpose of long-term tracking) and instead attaches great significance to something that most would view as relatively minor -- attaching to the bottom of a car a small, light object that does not interfere in any way with the car?s operation,? he wrote in a concurring opinion. ?"By contrast, if long-term monitoring can be accomplished without committing a technical trespass ? suppose, for example, that the federal government required or persuaded auto manufacturers to include a GPS tracking device in every car ? the court?s theory would provide no protection."

The Justice Department had asked for even more sweeping evidence-gathering rights. It argued that placement of the GPS device on the suspect's car was akin to other forms of electronic evidence-gathering that the court has already allowed. The most analogous situation, the Justice Department argued, was placing a homing beacon, or "beeper," in a device that is given to a suspect ? for example, in the case cited by Justice, when illicit chemicals with a beeper attached were sold by a cooperating witness to a suspect.? But such beepers are placed into property with the permission of a third party and then accepted voluntarily by a suspect. That differs greatly from law enforcement attaching a gadget to a suspect's car, the court found. That makes the act less like surveillance and more akin to a search, affording it Fourth Amendment requirements.

"The government physically occupied private property for the purpose of obtaining information," Justice Antonin Scalia wrote. "We have no doubt that such a physical intrusion would have been considered a 'search' within the meaning of the Fourth Amendment when it was adopted."

Scalia was comfortable stopping there.

"It may be that achieving the same result through electronic means, without an accompanying trespass, is an unconstitutional invasion of privacy, but the present case does not require us to answer that question," he wrote, in a direct answer to Sotomayer's complaint. "There is no reason for rushing forward to resolve them here."

Rasch found deep faults in Scalia's logic. Police "attach" things to citizens' automobiles all the time. Parking tickets, for example, or chalk marks as a reminder to meter maids that cars may have exceeded hourly requirements. The act of installing something on a car is not itself trespassing, he argued ? it?s the act of using such a device to track a citizens' movement over time without a warrant that raises constitutional issues.?

"'Hands off my car,' is the best way I can put this ruling," he said, adding that he thought the court had failed by issuing such a narrow ruling.

"They've avoided the issue. They were asked to address the Fourth Amendment issues, and they decided a trespassing case," he said. "You don't need the Supreme Court for that."?

LA detective in Simpson-Goldman murders dies at 70

Philip Vannatter, the Los Angeles police detective who served as a lead investigator in the 1994 murders of Nicole Brown Simpson and Ronald Goldman, has died in Southern California, according to his brother. He was 70.

Vannatter died Friday at a Santa Clarita hospital of complications from cancer, his brother Joe Vannatter told The Associated Press on Sunday.

He was among the first detectives on the scene at former football star O.J. Simpson's mansion in June 1994, following the stabbing deaths of Simpson's wife Nicole and her friend, Ron Goldman. Vannatter testified at the murder trial, at which Simpson was acquitted.

In 1977, Vannatter conducted the investigation that led to the arrest of film director Roman Polanski on charges he drugged and had unlawful sex with a 13-year-old girl.

A 28-year veteran with the LAPD, where he spent most of his career as a homicide detective, Vannatter retired from the force in 1995 but continued on as a consultant for cold case murders.

"He was a very devoted detective," Joe Vannatter said, adding his brother worked some 250 murder cases in his career. "The last time I saw him he had gotten a call from LAPD that they solved a homicide he was involved in 30 years ago. He took great pride in that."

Vannatter arrested Polanski in the lobby of the Beverly Wilshire hotel in Beverly Hills, kicking off an international legal saga that escalated when the director fled to France after he was convicted. As he put the cuffs on, Vannatter said he found Polanski was clutching a Quaalude, the drug he was accused of giving his young victim.

Vannatter had planned to retire in late 1994 but instead spent more than a year in the middle of the Simpson trial. Along with fellow detective Mark Furman, Vannatter's name often featured in headlines and his face was a common sight on cable news shows.

Defense lawyers took aim at Vannatter's truthfulness, suggesting police set out to get Simpson as soon as his ex-wife was found slain.

The defense argued that the search of Simpson's estate was illegal and that all evidence seized ? including a bloody glove, bloody socks and bloody drops ? should be thrown out.

On the witness stand, Vannatter sharply defended the actions of detectives at the crime scene. Two judges upheld the search on the basis of Vannatter's and other detectives' testimony that they were trying to inform Simpson of the death and that it became an emergency after blood was discovered on Simpson's Bronco and they feared people in Simpson's house might be injured.

"I don't think anybody's ever been in the news like that. ... It's history now. Obviously we're disgusted about what happened," Vannatter said in 1995 of Simpson's acquittal.

Joe Vannatter said his brother took the spotlight ? and the criticisms ? that came with the Simpson trial in stride.

"He was very upbeat and he knew he did the right thing," Joe Vannatter said about his brother's involvement in the case. "He had such thick skin. They felt that they had the right person that committed this horrendous crime."

During retirement Vannatter lived part time on a farm in Indiana, where he served for four years as a deputy sheriff in the town of Vevay, pop. 1,683.

Before joining law enforcement, the West Virginia native served in the U.S. Army.

Besides his brother, Vannatter is survived by his wife, Rita; their daughter, Donna; their son, Matthew, an LAPD officer; and five grandchildren.

Services are planned for Wednesday at Forest Lawn Memorial Park in Hollywood. A fund has been established in Vannatter's name with the Los Angeles Police Memorial Foundation.

Klum and Seal: 'We have decided to separate'

Heidi Klum and Seal confirmed Sunday that they are separating.

It's official: Supermodel and "Project Runway" host Heidi Klum and singer Seal are officially separating after seven years together.

TMZ first reported on Saturday that Klum was going to file for divorce as early as this week. On Sunday night, the pair confirmed the split in a statement to People.

"While we have enjoyed seven very loving, loyal and happy years of marriage, after much soul-searching we have decided to separate," the?pair told the magazine.?

"We have had the deepest respect for one another throughout our relationship and continue to love each other very much, but we have grown apart. This is an amicable process and protecting the well-being of our children remains our top priority, especially during this time of transition."

Klum and Seal have three biological children together, and the singer adopted the model's eldest daughter, Leni, from a previous relationship.

"They've had a very rough road lately," a friend of the couple told Us Weekly on Saturday.?"They're either madly in love or having? crazy fights."

Kristin Cavallari, Jay Cutler Confirm Pregnancy

And then there were three. Former "Hills" star Kristin Cavallari and her football-playing fiancé, Jay Cutler, have confirmed that they are soon going to be parents.

"We are thrilled to announce we are expecting our first child together," the couple said in a statement to People.com. "It's an amazing time in our life and we can't wait to meet the new addition to our growing family."

The road to parenthood has had its ups and downs for the duo. After initially getting engaged in April 2011, the soon-to-be parents called it off in July, reportedly while they were knee-deep in planning their wedding.

However, after several months apart, the couple confirmed that they were once again engaged in November. The football player asked the former reality starlet to marry him with a 5.2-carat engagement ring.

"She is really happy. She is in the early stages, but she can't wait to be a mom," a source told USmagazine.com. "They have just bought a house in Tennessee and can't wait to start their family."

In an interview with the magazine, Cavallari opened up a bit about her on-again, off-again relationship with Cutler. "The past year has been interesting," she said in December, shortly after they got back together. "There have been a lot of ups and downs, but overall it's been great. We're just enjoying being engaged," she added. "We were definitely planning the first time, but I can't plan the same wedding. I need to do something entirely different."

Before settling down with Cutler, Cavallari had a reputation for being quite the man-eater. On her stints on both "Laguna Beach" and "The Hills," the small screen's biggest vixen hooked up with Justin Bobby Brescia, Brody Jenner and Stephen Colletti.

You can now circle the White House on Google+

Considering that President Obama is on just about every major social media service, it's should come as no surprise that there is now a Google+ account for the White House as well.

Deputy director of outreach for the office of digital strategy?? yowza, that's a long job title???Kori Schulman revealed this news on the White House blog on Friday.

"On day one, President Obama made clear that this Administration is committed to public engagement and participation," Schulman writes. "That?s why [this administration] launched the 'We the People' petitioning tool and why you can find the White House on Twitter, Facebook, LinkedIn and other places around the Web."

The newly created White House Google+ page?will be used?to share news from the official White House blog, behind the scenes photos, and videos, Schulman says.?In addition, there will be regular "White House Hangouts" with administration officials.?(Only some users will be invited to join these Hangouts, but everyone will be able to watch the entire events live on WhiteHouse.gov, the Google+ page or on the White House YouTube channel.)

(AP) ? The State Department said Friday it "may have no choice" but to close the U.S. embassy in Damascus and remove all US personnel from the country wracked by a 10-month revolt against the regime of President Bashar Assad unless Assad's government takes extra steps to protect the mission.

The department issued a statement late Friday noting that the Obama administration has "serious concerns about the deteriorating security situation in Damascus, including the recent spate of car bombs and about the safety and security of embassy personnel."

The uprising against Assad has killed an estimated 5,400 people since March. Although the revolt began with mostly peaceful protests, an increasingly strong armed element has developed, and many people are now fighting the regime.

The department said the administration has asked Syria to take additional security measures to protect the U.S embassy and that the Syrian government "is considering that request."

But it also said it warned Assad's government that "unless concrete steps are taken in the coming days we may have no choice but to close the mission."

The U.S. removed its ambassador to Syria, Robert Ford, from Damascus in October over security concerns. He returned to Syria in December.

The administration argued at the time that Ford's presence in Syria was important for advancing U.S. policy goals by meeting with opposition figures and serving as a witness to the ongoing violence.

The Obama administration has long called for Assad to step down, and officials say his regime's demise is inevitable.

U.S. officials say Syria has become increasingly isolated, with Iran as one of its last remaining allies, and point to recent defections by some military and government leaders as a sign that Assad's grip on power is unraveling. The 10-month uprising against Assad has turned increasingly militarized and chaotic as more frustrated regime opponents and army defectors arm themselves and fight back against government forces.

(AP) ? About 250,000 electric customers around Seattle, Tacoma and Olympia are without power because of a winter storm that coated much of Washington state in ice and swelled Oregon rivers, killing three people.

Most are customers of Puget Sound Energy, which says it could take into the weekend or later to get the power back on for everyone.

The National Weather Service says warming temperatures Friday should melt snow and ice in Western Washington lowlands as the forecast promises the usual rain into next week.

Forecasters say the melting snow could cause urban and small stream flooding and fill the Skokomish and Chehalis rivers above flood stage by Saturday evening. More rain is forecast early next week that could make flooding more of an issue.

Google: We will continue to invest in Google Wallet

A giant question mark hanging fairly quietly over the head of Android (and maybe moreso Google) has been Google Wallet. That's the service that lets you pay for things with a credit card account simply by tapping your phone on a payment terminal.

But Google Wallet remains a Sprint (and Citi Mastercard) exclusive, only on the Sprint Nexus S 4G. It's not officially on the new Samsung Galaxy Nexus. It's not officially on Android 4.0 Ice Cream Sandwich. That's not to say we don't have it on other devices -- it's just not official. And that's furrowed a lot of brows.

Google gave a brief non-update today in the Q&A portion of its Q4 earnings call. Google senior vice president Susan Wojcicki gave us the following: 

"We want to focus on products that people use every fay -- products at our core. And all of us use our wallet every day. And we think it's a big opportunity for us. We are continuing to invest in our wallet business. And we see a lot of opportunity. For example, there might be opportunitites in the future how online and offline are linked together. And better opportunities with the way different parts of our business wind up working.

"So we are very excited about Wallet, and we will continue to invest in it."

Good to hear, but tell that to everybody not on the Sprint Nexus S 4G.

CyanogenMod 9 Alpha 0 brings Ice Cream Sandwich to HP TouchPads

If you'd like to run Android 4.0 on your HP TouchPad in stead of watching videos of someone else doing it, your time is now, as an early Alpha 0 build of CyanogenMod 9 has just rolled out. Now, living on the bleeding edge will cause some discomfort when it comes to Market access, hardware accelerated video and using the slate's camera, but fixes are expected as the project continues on. Also fresh for this release is the full source code, if you'd like to truly roll your own edition of Ice Cream Sandwich -- if you're wondering, a triple boot webOS / CM7 / CM9 configuration is reportedly possible, but not recommended. 'Artist,' 'Descendants' score top Globe wins (AP)

BEVERLY HILLS, Calif. ? The black-and-white silent film "The Artist" led the Golden Globes with three wins Sunday at a show that spread Hollywood's love around among a broad range of films, including best drama recipient "The Descendants" and its star, George Clooney.

Wins for "The Artist" included best musical or comedy and best actor in a musical or comedy for Jean Dujardin. Along with best drama, "The Descendants" won the dramatic-actor Globe for Clooney.

The dual best-picture prizes at the Globes could set up a showdown between "The Artist" and "The Descendants" for the top honor at next month's Academy Awards.

Other acting winners were Meryl Streep, Michelle Williams, Christopher Plummer, and Octavia Spencer, while Martin Scorsese earned the directing honor.

"I gotta thank everybody in England that let me come and trample over their history," said Streep, earning her eighth Globe, this time as dramatic actress for playing former British Prime Minister Margaret Thatcher.

Williams won for actress in a musical or comedy as Marilyn Monroe in "My Week With Marilyn," 52 years after Monroe's win for the same prize at the Globes for "Some Like It Hot."

The supporting-acting Globes went to Plummer as an elderly widower who comes out as gay in the father-son drama "Beginners" and Spencer as a brassy housekeeper joining other black maids to share stories about life with their white employers in the 1960s Deep South tale "The Help."

"With regard to domestics in this country, now and then, I think Dr. King said it best: `All labor that uplifts humanity has dignity and importance.' And I thank you for recognizing that with our film," Spencer said.

Scorsese won for the Paris adventure "Hugo." It was the third directing Globe in the last 10 years for Scorsese, who previously won for "Gangs of New York" and "The Departed" and received the show's Cecil B. DeMille Award for lifetime achievement two years ago.

He won over a field of contenders that included Michel Hazanavicius, who had been considered by many in Hollywood as a favorite for his black-and-white silent film "The Artist."

Williams offered thanks for giving her the same award Monroe once won and joked that her young daughter put up with bedtime stories for six months spoken in Monroe's voice.

"I consider myself a mother first and an actress second, so the person I most want to thank is my daughter, my little girl, whose bravery and exuberance is the example I take with me in my work and my life," Williams said.

Dujardin became the first star in a silent film to earn a major Hollywood prize since the early days of film. He won as a silent-era star whose career unravels amid the rise of talking pictures in the late 1920s.

It's a breakout role in Hollywood for Dujardin, a star back home in France but little known to U.S. audiences previously. His French credits include "The Artist" creator Hazanavicius' spy spoofs "OSS 117: Cairo, Nest of Spies" and "OSS 117: Lost in Rio."

While the musical or comedy categories at the Globes offer recognition for lighter films amid Hollywood's sober-minded awards season, the winners usually are not serious contenders for the Oscars. The last time the winner for best musical or comedy at the Globes went on to claim best-picture at the Oscars was nine years ago with "Chicago."

This time, though, "The Artist" and Dujardin have enough critical mass to compete at the Oscars with dramatic counterparts such as "The Descendants" and Clooney.

Both films have a good mix of laughs and tears. "The Artist" could be called a comedy with strong doses of melodrama, while "The Descendants" might be described as a drama tinged with gently comic moments.

Directed by Alexander Payne ("Sideways"), "The Descendants" provided a more down-to-earth role for Clooney, who's often known for slick, high-rolling characters such as those in his "Ocean's Eleven" heist capers and or the legal saga "Michael Clayton."

Adapted from Kaui Hart Hemmings' novel, "The Descendants" casts Clooney as Matt King, the scion of an aristocratic Hawaiian clan and a neglectful dad suddenly forced to hold together his two spirited daughters after his wife falls into a coma from a boating accident.

Along the way, Matt uncovers a staggering secret about his marriage and comes to reevaluate the principles under which he's lived his life.

Charming audiences since it premiered last May at the Cannes Film Festival, "The Artist" tells the story of George Valentin (Dujardin), a big-screen superstar known for adventurous comic capers alongside his adorable dog, who's always at his side on screen and in real life.

As talking pictures take over and the Depression hits, George loses everything ? his career, his marriage, his fortune and his home. Through it all, he has a guardian angel in Peppy Miller (Berenice Bejo, a supporting-actress Globe nominee and Hazanavicius' real-life romantic partner). A rising talkies star, Peppy got her career going with help from George, and she now aims to repay the favor.

The only time silent films have won best-picture or acting Oscars was in the awards first year, for 1927-28, 16 years before the Golden Globes even started.

At that first Oscar ceremony, when the transition to the sound era was just under way, the silent winners included the war story "Wings" as outstanding picture and the marital betrayal tale "Sunrise" as most unique and artistic picture, the only time that category was used. Janet Gaynor won as best actress for "Sunrise" and two other silent films, while Emil Jannings was picked as best actor for the silent films "The Last Command" and "The Way of All Flesh."

Other than some short silent films and one silent foreign-language nominee in 1983, it's been all talkies among contenders for top honors during Hollywood's awards season in the 83 years since the first Oscars.

"The Artist," which led the Globes with six nominations, also won the musical-score prize for composer Ludovic Bource.

Among its losses was for screenplay, a prize that went to Woody Allen for his romantic fantasy "Midnight in Paris," the filmmaker's biggest hit in decades. Never a fan of movie awards, Allen was a no-show at the Globes.

Steven Spielberg's "The Adventures of Tintin" won for best animated film, while the Iranian tale "A Separation" was named the foreign-language winner.

Ricky Gervais, who has ruffled feathers at past shows with sharp wisecracks aimed at Hollywood's elite and the Globes show itself, returned as host for the third-straight year. He started with some slams at the Globes as Hollywood's second-biggest film ceremony, after the Oscars.

Gervais joked that the Globes "are just like the Oscars, but without all that esteem. The Globes are to the Oscars what Kim Kardashian is to Kate Middleton. A bit louder, a bit trashier, a bit drunker and more easily bought. Allegedly. Nothing's been proved."

He also needled early winners, saying the show was running long and stars needed to keep their speeches short.

"You don't need to thank everyone you've ever met or members of your family, who have done nothing," Gervais said. "Just the main two. Your agent and God."

Netanyahu deputy "disappointed" with Obama on Iran (Reuters)

JERUSALEM (Reuters) ? A senior Israeli official voiced disappointment in the Obama administration on Sunday, saying "election-year considerations" lay behind its caution over tough Iran sanctions sought by U.S. legislators.

While Washington has been talking tougher about Iran's nuclear work and threat to block oil export routes out of the Gulf if hit with harsher sanctions, new U.S. measures adopted on December 31 gave President Barak Obama leeway on the scope of penalties on the Iranian central bank and oil exports.

Moshe Yaalon, Israel's vice prime minister, contrasted the administration's posture to that of France and Britain, which he said "are taking a very firm stand and understand sanctions must be imposed immediately."

"In the United States, the Senate passed a resolution, by a majority of 100-to-one, to impose these sanctions, and in the U.S. administration there is hesitation for fear of oil prices rising this year, out of election-year considerations," Yaalon told Israel Radio.

"In that regard, this is certainly a disappointment, for now."

The Democratic president says he is determined to deny Tehran -- which insists its nuclear programme is for peaceful needs only -- the means to develop an atom bomb. His aides cast their sanctions strategy as a bid to work collaboratively with foreign powers and win over states that import Iranian oil without triggering price-boosting shocks to energy markets.

MIXED MESSAGES

The remarks by Yaalon, a member of Prime Minister Benjamin Netanyahu's right-wing Likud party, appeared to jar with praise centrist Defence Minister Ehud Barak offered last month for what he described as Obama's resolve against Iran.

Running for re-election in the face of Republicans who hold sway over big pro-Israel constituencies, Obama has sought to burnish his credentials as a friend of the Jewish state despite having frosty relations with Netanyahu.

In a phone conversation with the prime minister on Thursday, Obama "reiterated his unshakable commitment to Israel's security," the White House said. Both sides said the leaders' discussion dealt with Iran and Israeli-Palestinian peacemaking.

Reputed to have the Middle East's only nuclear arsenal, Israel sees the makings of a mortal threat in Iran's uranium enrichment and missile projects, and has threatened to resort to force if it deems diplomatic isolation of its foe a dead end.

The prospect of Israel worsening regional instability with a unilateral strike has stirred worry in war-weary Washington.

Obama's top military adviser, Joint Chiefs of Staff Chairman General Martin Dempsey, was due to make his first visit to Israel on Thursday.

Israeli media predicted Dempsey would seek to persuade his hosts not to "surprise" the United States on Iran. The U.S. embassy had no immediate information about the visit's agenda.

Yaalon, himself a former top armed forces commander, said Israel should not "leap forward" to attack Iran.

"But Israel has to be ready to defend itself," he said. "Let's hope we do not arrive at that moment."

Netanyahu sounded sanguine last week about the efficacy of big-power pressure on Iran, telling an Australian newspaper: "For the first time I see Iran wobble ... under the sanctions that have been adopted and especially under the threat of strong sanctions on their central bank."

Smaug In 'The Hobbit' Will Be 'Extraordinary'

Motion-capture wizard Andy Serkis took some time off from filming "The Hobbit" to hit the red carpet at the 2012 Golden Globes, but it seems like he left all of his precious Middle-earth secrets back in New Zealand.

When Serkis took some time to chat with MTV News' Josh Horowitz, he refused to give any clue what the legendary dragon Smaug might look like on the big screen. "I can't give any secrets away, none of those trade secrets," Serkis said. "I can't say that because actually it's still under wraps."

In "The Hobbit," Serkis reprises the role that made him a capture-performance all-star: Gollum. Additionally, he will step behind the camera as the director of the films' second unit.

An iconic character in J.R.R. Tolkien's mythological world, Smaug is the impetus for all of the action in Peter Jackson's upcoming "Lord of the Rings" prequel, "The Hobbit: An Unexpected Journey." Such a revered character is bound to come with a high level of security.

Serkis suggested that there might be more to his own secrecy than just avoiding spoilers. According to the actor, Weta Workshop is still working on the creature's look. "It's still a very secret character that is very closely safeguarded, and it's still in the design process," he said.

The little we do know about Smaug is more than enough to get us excited. Benedict Cumberbatch will voice Smaug in "The Hobbit" before going where no man has gone before as the villain in J.J. Abrams' next "Star Trek."

Serkis said that with Cumberbatch as Smaug, audiences certainly have something to look forward to. "With an actor like Benedict Cumberbatch playing him, it will be extraordinary," he said.

Not sure if this will help. I use "My Tracks" which displays your current speed, average speed, and High/low. You can toggle back and forth between Map view and stats.
