Strauss-Kahn, NY hotel maid reach agreement in sex case

NEW YORK (AP) ? Former International Monetary Fund chief Dominique Strauss-Kahn and a hotel maid who accused him of trying to rape her have reached an agreement to settle her lawsuit, likely ending a legal saga that forced the onetime French presidential contender's resignation and opened a floodgate of accusations against him, a person familiar with the case said Thursday.

Details of the deal, which comes after prosecutors dropped related criminal charges last year, weren't immediately known and likely will be veiled by a confidentiality agreement. That could prevent the two from speaking publicly about a May 2011 encounter that she called a brutally sudden attack and he termed a consensual "moral failing."

Lawyers for Strauss-Kahn and the housekeeper, Nafissatou Diallo, made the as-yet-unsigned agreement within recent days, with Bronx Supreme Court Justice Douglas McKeon facilitating that and a separate agreement to end another lawsuit Diallo filed against the New York Post, said the person, who spoke to The Associated Press on the condition of anonymity to discuss the private agreement. A court date is expected next week, though the day wasn't set, the person said.

Strauss-Kahn lawyer William W. Taylor III declined to comment. Lawyers for the housekeeper didn't immediately respond to phone and email messages.

Diallo, 33, and Strauss-Kahn, 63, crossed paths when she arrived to clean his luxury Manhattan hotel suite. She told police he chased her down, tried to yank down her pantyhose and forced her to perform oral sex.

The allegation seemed to let loose a spiral of accusations about the sexual conduct of Strauss-Kahn, a married diplomat and economist who had long been dubbed the "great seducer." He now faces charges linking him to a suspected prostitution ring in his home country.

With DNA evidence showing a sexual encounter and Diallo providing a gripping description of an attack, the Manhattan district attorney's office initially said it had a strong and compelling case. But within six weeks, prosecutors' confidence began to ebb as they said Diallo had lied about her past ? including a false account of a previous rape ? and her actions after leaving Strauss-Kahn's room.

Diallo, who's from Guinea, said she told the truth about their encounter. But the district attorney's office dropped the charges in August 2011, saying prosecutors could no longer ask a jury to believe her.

Diallo had sued Strauss-Kahn in the meantime, with her lawyers saying she would get her day in a different court. Strauss-Kahn called the lawsuit defamatory and countersued her for $1 million.

Her lawsuit against the Post concerned a series of articles that called her a prostitute and said she sold sex at a hotel where the Manhattan DA's office had housed her during the criminal case. The News Corp. newspaper has said it stands by its reporting; a spokeswoman declined to comment Thursday.

In helping resolve the cases, McKeon averted what could have been an ugly court drama.

Strauss-Kahn initially said he had diplomatic immunity, an argument the judge turned down in May. Strauss-Kahn's lawyers had since asked McKeon to throw out part of her claim for other legal reasons. Court records show the judge had yet to rule on that and several other legal issues, and it appeared that a high-stakes step ? depositions, or pretrial questioning under oath ? had not yet been taken. Depositions can give both sides information and a better picture of how strong the key parties and other witnesses might be in court.

While the vast majority of civil cases end in settlements, some legal observers were surprised that the deal between Strauss-Kahn and Diallo came before the legal arguments were resolved.

"I really expected it to go a little farther," said Matthew Galluzzo, a criminal defense lawyer and civil litigator who has been following the Strauss-Kahn case closely.

Still, the case likely had taken a toll on both Diallo, a single mother of a teenage daughter, and Strauss-Kahn, who has found himself plagued by accusations of sexual misconduct that further tarnished his reputation. The Socialist had been seen as a potential leading candidate for the French presidency before his New York arrest.

In France, judges are to decide by Dec. 19 whether to annul charges linking him to a suspected prostitution ring run out of a luxury hotel in Lille. He acknowledges attending "libertine" gatherings but denies knowing that some women present were paid.

In August, a separate case against Strauss-Kahn, centered on allegations of rape in a Washington, D.C., hotel, was dropped after French prosecutors said the accuser, an escort, changed her account to say she wasn't raped.

Soon after Strauss-Kahn's arrest in New York last year, French writer Tristane Banon accused him of attempting to rape her during an interview in 2003, a claim he called imaginary and slanderous. Prosecutors said they believed the encounter qualified as a sexual assault, but the legal timeframe to pursue her complaint had elapsed.

The Associated Press does not name people who report being sexually assaulted unless they come forward publicly, as Diallo and Banon have done.

Strauss-Kahn has separated from his wife, journalist and heiress Anne Sinclair, who stood by him through the allegations in New York. The two said they were filing a lawsuit this summer against a French magazine, citing invasion of privacy, for reporting they had split, but Sinclair later acknowledged it was true.

The New York Times first reported the agreement between Strauss-Kahn and Diallo.

A 17-year-old awoke to smoke in her Forestville home Tuesday morning and escaped through a bedroom window before a fire destroyed the residence.

The teen, her mother and little sister lost their Vellutini Road home and two family dogs, one the family had for 12 years and a bull mastiff puppy, according to Forestville Fire Chief Max Ming.

The fire chief said there apparently weren't any smoke detectors inside and the teen was lucky she awoke.

"She jumped out her window and called for her dogs," Ming said.

The teen, Kyah Caster, called for help at 8:43 a.m.

She initially told dispatchers she feared her mother could still be inside, but then discovered her mom and 5-year-old sister already had left.

A Forestville engine crew arrived at 8:51 a.m. The small, single-story home was engulfed in flames.

The home, off Martinelli Road, was a few miles up into the hills above the Russian River.

Russian River and Graton firefighters also responded. Multiple fire engines and water trucks crowded the narrow lane, cramming into driveways and around a fire hydrant near the home.

The fire apparently started in the kitchen. The cause was under investigation but initially it appeared to be accidental, Ming said.

A few things were salvaged from the remains, but the residents, Darcy Kotta and her two daughters, lost their home and virtually all of their belongings.

The local Red Cross was called to help.

• Ensure the resident has got a Lasting Power of Attorney or a Living Will that they wish to follow.

• We must attempt to ascertain and record any personal wishes in relation to residents eventual death.
• We welcome the involvement of relatives and friends in the information gathering process, provided permission is sought from the resident.

?CARE PRIOR TO DEATH

• We aim to provide the best physical care for a dying resident, seeking expert advice on specific needs, pain control and other disorders.? We strive to assist to provide peace of mind preparing for death with residents and their relatives.
• Once a resident has been diagnosed and their care needs assessed and the decision taken that the individual needs palliative care, the palliative care plan would be put into practice.? This also provides specific information e.g. care provided, name of funeral director etc. and whether cremation or burial has been requested.
• We attempt to provide a homely environment within a resident?s room, even if special equipment is required.
• If a wish has been expressed to move to hospital/hospice, all assistance will be given and advice sought.
• Recognise acute and often distressing emotions experienced at a time close to death and try to offer comfort and support.

• We would (where possible) endeavour to offer comfort and support to family members and friends during this emotional time.

?

• We actively encourage family and friends to visit where welcomed by a dying resident and try to make them as comfortable as possible.? We encourage family to stay with the resident if they wish.
  
• We are also aware that hearing is one of the last senses to be lost and we are aware of talking sensitively in front of that resident and any distressing conversations would be held outside the room.
• We respect the beliefs and spiritual needs of a dying resident and will seek expert advice when dealing with residents who subscribe to religious or other groups of which we have little experience.
• When a resident is seriously ill or passes away, they are remembered in our monthly Home?s Communion Service, and residents committee meeting within each home.

AFTER DEATH

• Remember that it is possible for the deceased to take a gasp of air after death, no pulse means death.

• We will ensure we communicate with the Next of Kin or whoever is the main point of contact as soon as possible after the death, providing whatever help we can.
• We will treat the deceased with the utmost respect in accordance with the wishes of the deceased?s family and friends.
• During illness and after death we will be sensitive to the needs of the other residents.
• We will make efforts to enable residents and staff to attend the funerals if they wish.? Of course, permission from the relatives will be sought first.

?PROCEDURE ON EXPECTED DEATH OF A RESIDENT? i.e. IF THE RESIDENT HAS BEEN SEEN BY GP WITHIN LAST 14 DAYS AND GP CONFIRMS CONDITION IS TERMINAL

• Senior person on duty/on call should be contacted to confirm death.
• Record time, date and circumstances of death on MAR sheet.
• Call GP to confirm death or the registered nurse from Hill House who is qualified to do so.
• Inform relatives, proprietors and Manager of death ? Record time on resident?s M.A.R.
• Call chosen undertakers, ensure time is appropriate so that deceased can be discreetly removed, taking into account other residents and relatives.

• Check on the care plan if there are any religious or cultural considerations before handling the body.

?

• Check the deceased is clean and tidy, and laid out as flat as possible.? Open window a little.
• Make a note or remove all jewellery before resident is removed by undertakers.
• If own GP did not certify death, phone surgery at 9.00am next morning to inform residents GP.
• Ensure after deceased is removed, room is left tidy.? Remove all laundry and bedding.

UNEXPECTED DEATH IF RESIDENT HAS NOT BEEN SEEN WITHIN 14 DAYS? BY GP FOR TERMINAL CONDITION

• Record the time and circumstances of death accurately and do not move any possible evidence.? Document jewellery and clothes on deceased.
• The deceased must remain untouched, the police should be contacted.
• GP called to certify death who will then call the Coroner/their representative.
• Advise relatives, proprietor and Manager of death.
• The Coroner/representative will arrange for undertaker to remove the body.
• If own GP did not certify, telephone surgery at 9.00am next working day to inform registered GP.
• The staff on duty must document circumstances leading to death which may be called upon by Coroner.
• Ensure after deceased is removed, room is left tidy.? Remove all laundry and bedding.
• CQC must be informed of the death of a resident ? a Reg. 16 ? 20 form must be completed and sent.

ACTION OF RELATIVES

• To make contact with chosen undertakers.
• To telephone surgery at 9.00 am next day to confirm suitable time to collect Death Certificate.
• To inform the home of certified cause of death at earliest possible time so they may notify the Commission.

LEGAL REQUIREMENTS

The following information must be sent to CQC within 24 hours of death:

The defense minister made the surprise announcement even after polls showed his breakaway Independence Party gaining momentum after Israel's recent military offensive in the Gaza Strip.

Barak, Israel's most-decorated soldier and one-time prime minister, said he would stay on in his current post until a new government is formed following the Jan. 22 balloting.

"I feel I have exhausted my political activity, which had never been an object of desire for me. There are many ways for me to serve the country, not just through politics," he said, adding that his decision was spurred in part by his desire to spend more time with his family.

His resignation could mean the departure of the most moderating influence on hawkish Prime Minister Benjamin Netanyahu, who holds a wide lead in polls and is expected to easily win re-election. Barak, who heads a small centrist faction in parliament, often served as Netanyahu's unofficial envoy to Washington to smooth over differences with the Obama White House.

His impending departure comes at a key time for Israel, as the nation struggles to find its way in a region where the old order of Arab autocrats has been swept aside by the Arab Spring and the rise of Islamist political parties. Israel also faces a looming decision on whether to attack Iran's nuclear program, which the Jewish state fears is designed to develop atomic weapons ? a charge Tehran denies.

Less than a week ago, Barak led an eight-day military offensive against the Hamas militant group that rules the Gaza Strip. The fighting, aimed at ending rocket fire from the Palestinian territory. ended in a fragile truce.

"I didn't make this decision (to leave politics) without hesitating, but I made it wholeheartedly," he told a hastily arranged news conference, saying he had been wrestling with the decision for weeks.

He evaded repeated questions about whether he might agree to serve as a Cabinet minister in an upcoming government, leaving open the possibility that he might still retain an impact on Israeli politics. While most Cabinet ministers also hold parliamentary seats, they do not have to be elected lawmakers, and such appointments have been made in the past.

Barak, 70, made the surprise announcement even after polls showed his breakaway Independence Party gaining momentum after the Gaza campaign.

Despite the bump in the polls, Barak still could have found himself fighting for his political survival once election day rolls around. Surveys before the Gaza operation were unkind to his party, at times showing it polling too weakly to even send a single representative to parliament.

"I feel I have exhausted my political activity, which had never been an object of desire for me. There are many ways for me to serve the country, not just through politics," he said, adding that his decision was spurred in part by his desire to spend more time with his family.

Possible replacements include Vice Premier Moshe Yaalon, a former military chief, and Shaul Mofaz, a former military chief and defense minister, who now serves as chairman of the opposition Kadima Party.

Barak's political career was as turbulent as his 36-year military career was dazzling.

OWINGS MILLS, Md. (AP) ? Baltimore Ravens safety Ed Reed avoided a one-game suspension for late hits after an appeal. He instead will be fined $50,000.

Reed was suspended for one game without pay on Monday by NFL vice president of football operations Merton Hanks for his third violation in three seasons of the rule prohibiting helmet-to-helmet hits against defenseless players. The third violation occurred in Sunday night's game at Pittsburgh: Reed's hit to the head of receiver Emmanuel Sanders.

Reed appealed the ruling in phone session Tuesday morning with NFL hearing officer Ted Cottrell. The NFL Players Association represented Reed, who also participated.

Hours later, Cottrell reduced the penalty.

In a letter to Reed, Cottrell wrote: "I have determined that your actions were egregious and warrant significant discipline. However, I do not believe that your actions were so egregious as to subject you to a one-game suspension without pay. Player safety is the league's primary concern in the formation of playing rules and all players are expected to adhere to those rules or face disciplinary action. I hope in the future you will focus on ensuring that your play conforms to the rules."

Way back at CES we got our eyes on the duo's full lineup of co-branded headphones and speakers, and now folks in the US can officially get their hands on two such offerings (Tim Stevens approved racing-gloves not required). All About Abatements in Service Tax

Abatement has been provided in Notification no. 26/2012 dated 20.6.2012 effective from 1.7.2012

1.Financial leasing services- 10% taxable

Financial leasing includes hire charges but excludes operating lease

• The value of taxable service would be 10% i.e. abatement of 90% has been granted unconditionally.
• Taxability is defined as follows:

-Interest chargeable to the extent of 10%

-Principal amount not subject to tax

- Fees based income such as lease management fees, processing fees, documentation charges and administrative fees would be fully taxable.

Distinction between financial lease and operating lease

Financial lease : financial lease is usually long term agreement covering entire economic life of assets. Whole investment is recovered by lessor plus his profit. Assets is usually maintained by lessee. It is not cancellable contract. Practically lessee become owner not legally.

Operating lease :? operating lease is for short term . Asset may be given to more than one parties on lease during the economic life of the asset. Hence cost of the assets is not recovered in one contract of lease. Usually , lessor upkeep and maintain the asset.? For example , computer or furniture given on rent.

Constitutional validity ??

In association of leasing and financial service companies v. Union of India [2010] 29STT316 the Supreme Court held that service tax imposed on value of taxable services , in so far as relates to financial leasing including equipment leasing and hire purchase is within the legislative competence of Parliament under Entry 97, List I? of the Seventh Schedule to Constitution.

2. Transport of Goods by Rail ? 30% taxable ?

Abatement of 70% has been granted unconditionally.

Essential ingredient to avail abatements

• Service should be in relation to transport of goods
• Such transportation shall be by rail.

3. Transport of passenger by rail ? 30% taxable

Abatement of 70% has been granted unconditionally

Transport of passenger by metro, monorail and tramway have? been included in the negative list and are therefore out of the tax net.

4.? Supply of Food and any other Article- ?70% taxable

Specially arranged place : Abatement of 30%

Supply of food or any other article of human consumption or any drink , in the premises( (including Hotel , convention centre, club, pandal , shamiana or any other place specially arranged for organizing function) together with renting of such premises would get benefit of abatement.

The abatement is subject o the condition that CENVAT credit on any goods classifiable under chapter 1 to 22 of the Central Excise Tariff Act,1985 has not been taken under the provision of the CENVAT Credit Rules ,2004.

Consideration include free supplies also to service provider

Valuation of service is in Restaurant or by outdoor caterer :

w.e.f. ?1.7.2012 , as per the new rule 2C of the Valuation Rules :

The goods should be as follows :

• Any other article of human consumption

• Any drink (whether or not intoxicating)

The goods should be supplied in any manner as part of the activity

?Over lapping and conflicting between Rule 2C and abatement scheme

Rule 2C applies if food is provided in restaurant or outdoor without any other services. However , if service is provided at any other place specially arranged for organising a function , the abatement scheme of 70% shall apply.

Exemption to restaurant without BAR and Air Conditioning : Sr. No 19 of the Notification No. 25/2012-ST , dated 20.6.2012

5. Transport of passenger by Air? ? 40% taxable

Abatement of 60% , this is subject to the condition that input and capital goods , used for providing the taxable services has not been taken under the provision of CENVAT Credit Rules ,2004.

6. Renting of hotels, inns etc.- 60% taxable ?

Abatement of 40%

Renting of hotels, inns, guest house , clubs, , campsites or other commercial places meant for residential or lodging purpose would get the abatement of 40%. It should be noted that abatement? is available only to the specified immovable properties.

This is subject to the condition that input and capital goods , used for providing the taxable services has not been taken under the provision of CENVAT Credit Rules ,2004.

7. Goods transport agency? ? 25% taxable

Abatement of 75%

This is subject to the condition that input, input services ?and capital goods , used for providing the taxable services has not been taken under the provision of CENVAT Credit Rules ,2004.

Transport of goods by road, other than GTA and courier agency, have? been fully exempt? as included in section 66D [p] of the ACT pertaining to the negative list.

What is good transport agency:? S. 65B [26] provides that ?Goods Transport Agency ? means any person who provide services in relation to transport of goods by road and issue consignment note, by whatever named called ?Goods Transport Agency? was identically defined in erstwhile section 65[ 50b] of the Act.

Contents of the consignment note has been defined under the explanation to Rule 4B.

8. Service provided in relation to chit -70% taxable

Abatement of? 30%

Chit means transaction whether called chit, chit fund, chitty, kuri or by whatever name by or under which a person enters into agreement with a specified number of person that every one of them shall subscribe a certain sum of money by way of periodical installments over a definite period and that each subscriber shall , in his turn? , as determined by lot or by auction or by tender or in such other manner as may be specified in the chit fund agreement, be entitled to prize amount.

9. Renting? of? any motor vehicle ? 40% taxable???

Abatement of 60%.

This is subject to the condition that input, input services? and capital goods , used for providing the taxable services has not been taken under the provision of CENVAT Credit Rules ,2004

Following are requisite for claiming rebate.

• Motor vehicle designed to carry passenger.

Rent means act of letting out or allowing the use of something for consideration. The expression ?rent a car? is defined in the dictionary as a car rented for day, week or other contracted time,? for fixed sum or according to mileage.

There is distinction between providing ?rent a cab service? and giving vehicle on lease / hire. If vehicle is given on lease / hire without driver, effective control over the vehicle passes to the person taking vehicle on hire. This becomes ? transfer of right to use goods? and may? be taxable under VAT, sine it is deemed sale of goods. If the effective control is not handed over to customer , the service will come under service tax. [ R.S. Travels v. CCE [2008] 15STT437 [ New Delhi CESTAT]

?10. Transport of goods in vessel from one port to another -50% taxable

Abatement of 50%.

This is subject to the condition that input, input services? and capital goods , used for providing the taxable services has not been taken under the provision of CENVAT Credit Rules ,2004

Transportation of goods from one port to another can be through? either national waterway? or inland waterway or otherwise . As transportation of goods through inland waterways [ which includes national waterway] has been included in the negative list[ section 66D(p)], there would be no service in that case.

Essential Ingredients

• Transportation should be n vessel

• Goods through inland water would be exempt

• Transportation of goods other than inland waterway and national waterway would get an abatement of 50%.

11. Tour operator services

Notification no. 26/ 2012 defines Tour operator means any person engaged in the business of planning, scheduling, organising , arranging tours[ which may includes arrangement of accommodation, sightseeing or other similar services] by any mode of transport, and includes any person engaged in the business of operating tours.

• Except those where entire consideration is received after issuance of completion certificate by the competent authority.
• This is subject to the condition that input used for providing the taxable services has not been taken under the provision of CENVAT Credit Rules ,2004.
• Value of land is included in the amount charged from the service recipient

Further ,for the purpose of valuation the amount charged shall be the sum total of the amount charged for the service including the fair market value of all the goods and services supplied by the recipient in or in relation to the services , whether or not supplied under the same contract or any other contract , after deducting :

1)??? The amount charged for such goods or services supplied to the service provider , if any: and

2)??? The value added tax or sales tax , if any, levied thereon.

Ah, that new car smell: NASA technology protects spacecraft from outgassed molecular contaminants

ScienceDaily (Nov. 19, 2012) ? Outgassing -- the physical process that creates that oh-so-alluring new car smell -- isn't healthy for humans and, as it turns out, not particularly wholesome for sensitive satellite instruments, either. But a team of NASA engineers has created a new way to protect those instruments from its ill effects.

For some people, the best part about buying a new car is its factory-fresh new car smell, a distinctive aroma created when the chemicals and residual solvents used to manufacture dashboards, car seats, carpeting and other vehicle appointments outgas and fill the cabin. While the scent may be alluring to some, many researchers believe exposure to these gases isn't particularly healthy -- so unhealthy, in fact, that some recommend that drivers keep their new cars ventilated while driving.

Outgassed solvents, epoxies, lubricants, and other materials aren't especially wholesome for contamination-sensitive telescope mirrors, thermal-control units, high-voltage electronic boxes, cryogenic instruments, detectors and solar arrays, either. As a result, NASA engineers are always looking for new techniques to prevent these gases from adhering to instrument and spacecraft surfaces and potentially shortening their lives.

A group of technologists has created a low-cost, easy-to-apply solution, which is more effective than current techniques.

Led by Principal Investigator Sharon Straka, an engineer at NASA's Goddard Space Flight Center in Greenbelt, Md., the team has created a new, patent-pending sprayable paint that adsorbs these gaseous molecules and stops them from affixing to instrument components. Made of zeolite, a mineral widely used in industry for water purification and other uses, and a colloidal silica binder that acts as the glue holding the coating together, the new molecular adsorber is highly permeable and porous -- attributes that trap the outgassed contaminants. Because it doesn't contain volatile organics, the material itself doesn't cause additional outgassing.

"It looks promising," Straka said. "It collects significantly more contaminants than other approaches."

Advantages Over Current Techniques

Instrument developers currently use zeolite-coated cordierite devices that look like hockey pucks. Because each individual puck has limited adsorbing capabilities, instrument designers must install multiple units, which require complex mounting hardware. "These devices are big, heavy and chunky, and take up a lot of real estate," explained Co-Principal Investigator Mark Hasegawa, of NASA Goddard.

The new paint, however, overcomes these limitations by providing a low-mass alternative. Because technicians can spray the paint directly onto surfaces, no extra mounting equipment is necessary. In addition, technicians can coat adhesive strips or tape and then place these pieces in strategic locations within an instrument, spacecraft cavity, or vacuum system, further simplifying adsorber design. "This is an easy technology to insert at a relatively low risk and cost," Hasegawa said "The benefits are significant."

Since its development, Northrop Grumman, Redondo Beach, Calif.; the European Space Agency; the Laboratory for Atmospheric and Space Physics at the University of Colorado at Boulder; and Spica Technologies of Hollis, N.H., have expressed interest in using the material, Straka said. In addition, NASA's ICESat2 ATLAS project is evaluating its use, pending the outcome of additional tests, she said.

The team plans to tweak its recipe to enhance the paint's performance and experiment with different pigments, mainly black, to create a coating to absorb stray light that can overcome the light scientists actually want to gather. Straka also believes the technology could be used on the International Space Station or future space habitats to trap pollutants and odors in crew quarters.

"We're ready for primetime," Straka said. "The coating is undergoing qualification tests and is ready for infusion into flight projects or ground vacuum systems."
